These Terms and Conditions govern the use of the RefurbHub website and the purchase of products from RefurbHub.

By accessing, browsing or using this website, or by placing an order through the website, you acknowledge that you have read and understood these Terms and Conditions and agree to be bound by them, together with the other policies referred to on this website.

These Terms and Conditions are subject to applicable South African law, including applicable consumer-protection and electronic-commerce legislation. Nothing in these Terms and Conditions is intended to exclude, restrict or waive a consumer right that cannot legally be excluded or waived.

1. Definitions

In these Terms and Conditions:

“RefurbHub”, “we”, “us” or “our” means the business operating the RefurbHub website and supplying products through the website.

“Customer”, “you” or “your” means any person or entity purchasing products from RefurbHub or using this website.

“Product” or “Products” means any refurbished, used, reconditioned, new or other goods offered for sale by RefurbHub.

“Website” means the RefurbHub website and any associated online shopping pages operated by RefurbHub.

2. About RefurbHub

RefurbHub specialises in the sale of refurbished and pre-owned technology products, including computers, laptops, monitors, tablets, gaming equipment, accessories and related technology products.

Our refurbished products may previously have been owned or used and may have undergone inspection, testing, cleaning, repair, component replacement or other refurbishment processes before being offered for sale.

Where a product is refurbished, reconditioned or previously used, this will be indicated on the relevant product listing or otherwise communicated to the customer.

3. Important Information About Refurbished Products

Because RefurbHub sells refurbished and pre-owned technology, products may show reasonable signs of previous use depending on their condition and grading.

These may include:

• Minor scratches;

• Cosmetic marks;

• Signs of handling;

• Minor wear;

• Packaging differences; or

• Other cosmetic imperfections consistent with the product’s disclosed condition.

Such characteristics do not necessarily indicate that a product is defective.

Where a product has a known material defect, limitation or condition that is relevant to the customer’s purchasing decision, RefurbHub will endeavour to disclose this clearly in the relevant product listing.

Customers should review the complete product description, specifications, photographs, condition information and other information provided before placing an order.

4. Product Information and Specifications

We make reasonable efforts to ensure that product descriptions, specifications, photographs, prices and other information displayed on the website are accurate and up to date.

However, minor errors, typographical errors or discrepancies may occasionally occur.

Product photographs may be used for illustrative purposes where indicated. Actual products may differ slightly in appearance due to lighting, photography, screen settings, packaging or the condition of individual refurbished units.

Where a product has a specific condition grade, specification or included accessory list, the information stated on the relevant product listing will apply to that particular product.

Customers are responsible for reviewing the product specifications and ensuring that the product is suitable for their intended use before purchasing.

Nothing in this clause limits any rights the customer may have where a product does not comply with applicable consumer-protection requirements.

5. Product Availability

All products are subject to availability.

Because RefurbHub sells refurbished and pre-owned technology, certain products may be available in limited quantities, and individual products may differ in condition or configuration.

Adding a product to a shopping cart does not necessarily guarantee that the product has been reserved.

If a product becomes unavailable after an order has been placed, RefurbHub will notify the customer and provide an appropriate remedy in accordance with applicable law.

6. Pricing

Prices displayed on the website are stated in South African Rand (ZAR), unless otherwise indicated.

The applicable price will be the price displayed at the time the customer places the order, subject to obvious pricing errors.

Where applicable, delivery charges and other additional charges will be displayed or communicated to the customer before the order is finalised.

RefurbHub reserves the right to correct obvious pricing errors before an order is fulfilled.

If an obvious pricing error results in a product being advertised at a price that is materially incorrect, RefurbHub may contact the customer before processing the order to confirm whether the customer wishes to proceed at the correct price.

Where the customer does not wish to proceed, any amount paid for the affected order will be handled in accordance with applicable law.

7. Orders

When you place an order through the website, you are making an offer to purchase the selected product or products.

An order acknowledgement or automated confirmation email does not necessarily constitute final acceptance of the order.

RefurbHub may need to verify payment, product availability, pricing, delivery information or other order details before fulfilling an order.

Once an order has been accepted and payment has been successfully processed, RefurbHub will proceed with fulfilment subject to these Terms and Conditions.

8. Payment

Payment must be made using one of the payment methods made available by RefurbHub at checkout.

Where online payment is processed through a third-party payment provider, the payment transaction may also be subject to that provider’s terms and conditions.

RefurbHub does not store complete card details where payment is processed through an external payment gateway.

An order may be placed on hold or cancelled where payment cannot be verified, is reversed, is declined, or is reasonably suspected to be fraudulent or unauthorised.

9. Delivery

Products will be delivered using the delivery method selected or made available during checkout.

Delivery timeframes displayed on the website are estimates unless expressly stated otherwise.

Delivery may be affected by factors outside RefurbHub’s reasonable control, including courier delays, weather, public holidays, incorrect delivery information, operational disruptions and other circumstances beyond our reasonable control.

The customer is responsible for providing accurate delivery information.

If incorrect or incomplete information supplied by the customer results in additional delivery costs or delays, the customer may be responsible for reasonable additional costs where permitted by law.

Customers should inspect delivered packages as soon as reasonably possible and notify RefurbHub if the package appears materially damaged or if the wrong product has been delivered.

10. Risk During Delivery

RefurbHub will take reasonable steps to package products appropriately for delivery.

Where a product is damaged during delivery, customers should notify RefurbHub as soon as reasonably possible and provide photographs or other information that may assist with investigating the matter.

Nothing in this section limits any rights or remedies available to a customer under applicable consumer-protection legislation.

11. 10-Day Returns and Refunds

RefurbHub provides a 10-day return period for eligible returns, subject to the conditions set out in our Returns & Refund Policy.

Customers must contact RefurbHub within the applicable return period before sending a product back.

Change-of-mind returns are subject to the applicable return conditions, including reasonable requirements regarding the product’s condition, accessories and components.

Products that have been physically damaged, liquid damaged, tampered with, modified, repaired without authorisation or returned with missing components may be subject to the terms set out in the Returns & Refund Policy.

This does not limit any statutory rights that apply where a product is defective or otherwise does not comply with applicable law.

12. Warranty

Qualifying products are covered by a 3-month RefurbHub warranty, unless a different warranty period is expressly stated on the relevant product listing or invoice.

The warranty covers qualifying faults arising during normal and reasonable use.

The warranty does not generally cover accidental damage, liquid damage, misuse, unauthorised repairs, tampering, electrical damage, normal wear and tear, or other exclusions specified in our Warranty Policy.

The RefurbHub warranty operates in addition to any rights the customer may have under applicable South African consumer-protection legislation.

13. Customer Data and Device Security

Customers are responsible for backing up their data before returning a device for inspection, repair, replacement or refund.

Customers should remove personal accounts, passwords, security locks, SIM cards and memory cards before returning a device where reasonably possible.

RefurbHub is not responsible for loss of customer data, files, photographs, documents, software or other digital content during the return, repair, inspection or replacement process.

RefurbHub may reset a device where reasonably necessary to inspect, repair, test or prepare the product.

14. Website Use

You agree to use this website lawfully and responsibly.

You may not:

• Use the website for fraudulent or unlawful purposes;

• Attempt to gain unauthorised access to the website or its systems;

• Introduce malicious software, viruses or other harmful code;

• Interfere with the operation or security of the website;

• Attempt to obtain another customer’s personal information;

• Use automated systems to interfere with the website without permission;

• Reproduce or exploit website content for unauthorised commercial purposes; or

• Use the website in a manner that may damage RefurbHub, its customers or its service providers.

RefurbHub reserves the right to restrict or terminate access to the website where there is reasonable evidence of misuse, fraud, abuse or unlawful activity.

• Logos;

• Graphics;

• Marketing material; and

is owned by or licensed to RefurbHub and may be protected by applicable intellectual-property laws.

To the maximum extent permitted by applicable law, RefurbHub will not be responsible for losses that are not reasonably foreseeable or that arise indirectly from the use of the website or a product.

However, nothing in these Terms and Conditions excludes or limits liability where such exclusion or limitation is prohibited by law.

19. Fraud and Suspicious Transactions

RefurbHub reserves the right to investigate transactions that it reasonably believes may involve fraud, unauthorised payment, identity misuse, payment abuse or other unlawful activity.

Where reasonably necessary, an order may be placed on hold while verification is conducted.

RefurbHub may cancel or refuse to fulfil an order where there are reasonable grounds to believe that the transaction is fraudulent or unlawful, subject to applicable law.

20. Privacy and Personal Information

RefurbHub may collect and process customer information necessary to operate the website, process orders, communicate with customers, arrange delivery, provide customer support and comply with legal obligations.

Unless otherwise stated:

• Promotional offers are subject to availability;

• Promotional codes may have expiry dates;

• Promotional codes may not be exchanged for cash;

• Promotional codes may not be combined where expressly prohibited;

• A promotional offer may apply only to specified products; and

• RefurbHub may correct obvious errors relating to promotional pricing.

Specific promotional terms displayed at the time of an offer will apply to that offer.

24. Changes to Products and Policies

RefurbHub may update product information, website content, pricing, promotions and policies from time to time.

Changes will not affect a completed transaction in a manner that unlawfully removes or reduces a customer’s rights.

The Terms and Conditions applicable to an order will be those applicable at the time of the relevant transaction, subject to any mandatory legal requirements.

25. Complaints and Dispute Resolution

Customers are encouraged to contact RefurbHub directly if they have a complaint, concern or dispute regarding an order, product, delivery, return, refund or warranty claim.

We will make reasonable efforts to investigate and resolve legitimate complaints.

Where a dispute cannot be resolved directly, the parties may make use of any applicable statutory consumer-protection or alternative dispute-resolution mechanisms available under South African law.

Nothing in these Terms and Conditions prevents a consumer from exercising a statutory right to approach an appropriate regulatory or dispute-resolution body.

26. Governing Law

These Terms and Conditions are governed by the laws of the Republic of South Africa.

Any dispute will be dealt with in accordance with applicable South African law and the jurisdiction of the appropriate South African courts or other legally available dispute-resolution mechanisms.

27. Severability

If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable, that provision will be interpreted or limited to the extent necessary to make it enforceable where legally possible.

The invalidity or unenforceability of one provision will not automatically affect the validity of the remaining provisions.

28. Entire Agreement

These Terms and Conditions, together with the applicable:

• Order confirmation;

• Warranty Policy;

• Returns & Refund Policy;

• Delivery/Shipping Policy;

• Privacy Policy; and

• Any specific promotional terms

form the terms applicable to the customer’s transaction, subject to applicable law.

Where there is a conflict between these Terms and Conditions and a mandatory provision of applicable law, the mandatory legal provision will prevail.
